RESUME
La gardienne de la Constitution, à savoir la Cour Constitutionnelle de la République Démocratique du Congo est, elle-même, mal constituée de par sa composition, en violation des prescrits de l’article 158 al. 2 de la Constitution qui impose deux tiers des juristes et un tiers de non juristes, mais également l’article 14 de la même Constitution, qui prône la promotion du principe paritaire au sein des institutions de notre pays. En conséquence, une révision de la Constitution s’impose en vue d’y insérer clairement le quota des femmes qui vont siéger dans cette Cour afin d’éviter l’injustice et les inégalités.
ABSTRACT
The guardian of the Constitution, namely the Constitutional Court of the Democratic Republic of Congo, is itself poorly constituted by its composition, in violation of the prescriptions of article 158 al. 2 of the Constitution which imposes two thirds of jurists and one third of non-jurists, but also article 14 of the same Constitution, which advocates the promotion of the principle of parity within the institutions of our country. Consequently, a revision of the Constitution is necessary in order to clearly insert the quota of women who will sit in this Court in order to avoid injustice and inequalities.
